Gifted and Talented Program Complaint Process for Non-Compliance with N.J.S.A.18:35-39

An individual who believes that a school district has not complied with the provisions of N.J.S.A. 18A:35-39 et seq (Strengthening Gifted & Talented Act) may file a complaint with the Board of Trustees. The right to file a complaint is set forth in the Board’s Policy on Gifted and Talented Education (Policy 2464 – Gifted and Talented Students) which can be found on the school’s website, under Academics: Gifted and Talented or under Board: Board Policies. The Board shall issue a decision, in writing, to affirm, reject, or modify the district’s action in the matter. However, it is suggested that the individual address concerns the Gifted and Talented Coordinator pursuant to the internal process outlined below.

Please note that the alleged occurrence of noncompliance must have taken place within one year of filing the complaint.

Complaint Process

If a parent or legal guardian has a concern about the Gifted and Talented Program selection process, programming, curriculum or noncompliance, the following steps should be followed:

1.Parent/guardians should address their concerns initially to the Gifted and Talented Program Coordinator in writing via email, who will respond within five school days to discuss the issue.

2.If the issue is not resolved, the parent/guardian may contact the Principal, who will respond within ten school days to discuss the issue.

3.If the issue is still not resolved, the parent/guardian may submit a Gifted and Talented Complaint Form to the Link Community Charter School Board of Trustees. The board will discuss the complaint at the next Board of Trustees’ regularly scheduled meeting and will issue a decision in writing to affirm, reject, or modify the school’s action.

4.Finally, if the matter is still in dispute, parent/guardian can file a Petition of Appeal of the Board’s written decision to the Commissioner of Education through the Office of Controversies and Disputes in accordance with N.J.S.18A:6-9 and the procedures set forth in State Board of Education regulations.
